Unless otherwise agreed in writing, the following general terms and conditions apply to all business transactions. The general terms and conditions are agreed to if an order is triggered.

The prices of the online shop are inclusive of VAT, shipping and handling costs are shown separately. The prices are subject to change and can be changed at any time. The prices valid on the day of the order will be calculated.

Disposal  

Disposal of goods is not included in the price. No recycling fee is charged at the time of purchase, this will be due at any disposal by Shop2.ch GmbH and charged to the buyer based on the ACTUAL costs in addition to the handling costs.
 

 

Order and offers
 

The buyer commits to the Shop2.ch GmbH with his order. The order is made orally or in writing. A binding force for the Shop2.ch GmbH arises only after their written confirmation that the order is executed. The cancellation on the part of the supplier of Shop2.ch GmbH and cases of force majeure remain reserved.
 

For the accuracy of the order, the buyer is just as responsible as for the fact that Shop2.ch GmbH all information regarding the ordered product(s) within seven days after receipt of the order. A revocation of the contract by the buyer is only possible, as long as the Shop2.ch GmbH or its suppliers regarding the ordered commodity(ies) still no production actions made; for all damage / costs resulting from this the Shop2.ch GmbH is to be held harmless.
If the goods are manufactured by the Shop2.ch GmbH or otherwise as processed and/or If the goods are manufactured or otherwise processed by Shop2.ch GmbH and the buyer has submitted a specification for this purpose, the buyer shall indemnify and hold Shop2.ch GmbH harmless from and against any loss, damage, claim, costs or other expenses if the contractual manufacture, processing or treatment of the goods on the basis of this specification of the buyer proves or has proved to be a breach of a patent, copyright, trademark or other property right of a third party. Notwithstanding the above, Shop2.ch GmbH reserves the right to modify descriptions of our goods with regard to specifications of the buyer insofar as legal requirements are to be taken into account, and insofar as no deterioration of the order with regard to quality and usability occurs as a result of this modification.
The offers of Shop2.ch GmbH are subject to change and non-binding and become binding only through written confirmation after the aforementioned provisions of these GTC's have been specified.
 

 

The Shop2.ch GmbH is entitled to change and improve the goods, without having to inform the buyer in advance, as long as the change or improvement neither the form nor function of the goods sustainably burden or deteriorate.

 

Delivery time 

The Shop2.ch GmbH strives to meet specified delivery times; however, Shop2.ch GmbH can not assume a liability. Cases of force majeure are not the responsibility of Shop2.ch GmbH and entitle it to extend any agreed delivery periods. The delivery periods are automatically extended by the duration of the delay. Under cases of higher force are to be understood in particular however not exclusively also an operational standstill/outage not caused by us, strikes or orders of national authorities. In the event of delay, the purchaser shall be obliged to grant a reasonable period of grace. Claims for damages from delays in delivery are excluded.
 

 

Shipping and assembly

The Shop2.ch GmbH delivers from stock at the expense of the buyer to the specified address, or to the valley station. The place of unloading is ground level, e.g. goods receiving, ramp, warehouse, workshop. Transport / assembly within the building is at the expense of the buyer. For special transports, the purchaser must provide auxiliary personnel, lifts or cranes at his own expense. The assembly site must be prepared accordingly. If goods have to be moved, the additional costs shall be borne by the buyer. Partial deliveries are permissible. Changes after receipt of order, will be charged to the buyer additionally.
 

The goods travel at the risk of the recipient. In the case of delivery by camion, any transport damage must be notified to the driver of the vehicle immediately upon arrival of the goods. The damage must be noted on the duplicate of the delivery note. The LSVA is at the expense of the buyer. In the case of transport by rail or post, the recipient undertakes to obtain a statement of facts from the transport company in respect of any transport damage. The dispatch to private persons takes place in principle by cash on delivery.
If the buyer is in default of acceptance the Shop2.ch GmbH is entitled to arrange the storage of the goods at the risk and expense of the buyer.
Can assembly and commissioning for reasons not caused by the Shop2.ch GmbH is not at fault, the additional costs are borne by the buyer.

Warranty and repair service
 

We are happy to arrange an external repair service in case of problems with our machines. During the normal warranty period and the usual warranty conditions, we will cover the cost of any repairs that are due to material or manufacturing defects at our official service points. An extensive spare parts stock is available.
 

 

Payment terms

The following payment methods are available in our store: Master Card, VISA, PayPal, Twint, Postcard, Invoice as prepayment
 

 

Invoice

You will receive an invoice via email immediately after placing your order. The invoice amount shown on it is due and payable immediately. The order will only be executed upon full receipt of the full invoice amount.
 

 

Cash on delivery

If you choose the payment method cash on delivery, plus. 50.00 CHF as costs for transport with our transport service providers.
 

 

Paypal

You pay the invoice amount via the online provider Paypal. You must basically be registered there or register first, legitimize with your access data and confirm the payment instruction to us. You will receive further instructions during the ordering process.
 

Payments are to be made in Swiss francs (CHF). For the receipt of payment, the day on which Shop2.ch GmbH can dispose of the amount is decisive. The buyer waives any claims against Shop2.ch GmbH to offset against the purchase price.

 

Delay in payment

If the buyer exceeds a payment deadline, the buyer will be in default without prior reminder, and Shop2.ch GmbH is entitled to charge him additional default interest of at least 6% of the amount owed. Shop2.ch GmbH reserves the right to withdraw from the contract if the buyer is in default.
 

 

Retention of Title

All objects of purchase remain the property of Shop2.ch GmbH until full payment has been made Shop2.ch GmbH reserves the right to register the reservation of title.
 

 

Warranty and Disclaimer

The statutory warranty obligation of Shop2.ch GmbH for defects is hereby excluded. In their place the requirement of the buyer steps on free rework, if it indicates the lack during the agreed upon warranty period of the Shop2.ch GmbH. The guarantee period begins on the day of delivery. With a recognized lack Shop2.ch GmbH reserves itself to remove the lack by rework or against return of the commodity a replacement delivery to execute; claims of the buyer against Shop2.ch GmbH going beyond that remain reserving the case that a rework does not succeed also in the second attempt. The Shop2.ch GmbH reserves itself instead of the rework to replace parts of the object of the purchase. Replaced parts become the property of Shop2.ch GmbH. The warranty for Shop2.ch GmbH goods does not cover product defects that occur due to faulty installation or use, misuse, negligence or other reasons on the part of the purchaser or third parties. In addition, no warranty for malfunctions or damage to our goods, in particular but not exclusively for the following reasons, are taken over:
 

 

  • Inappropriate or improper use or negligent handling of the goodsby the buyer and / or third parties.
  • Faulty assembly or commissioning of the goods by the buyer and / or third parties. Commissioning of the goods by the buyer and / or third parties.
  • Deviation from agreed or usual operating conditions or omitted instructions of the buyer according to these GTC's.
  • Non-compliance with the operating instructions or prescribed operating data or omission of the maintenance provided in the operating instructions by the buyer and / or third parties.
  • Natural wear and tear is not considered a defect. (Example:calcification)

 

The warranty period is not changed by the rectification, but continues without interruption. For newly inserted parts, the remaining warranty period of the replaced parts shall apply. The buyer has no right to compensation for any direct or indirect damage caused by the defect of the object of purchase (eg lost profits, damage to goods, production losses, etc.).
The buyer is obliged to check the goods immediately after receipt for completeness, correctness and other freedom from defects and to address any notices of defects within 2 days of receipt in writing to Shop2.ch GmbH, otherwise the corresponding rights to warranty will lapse.
This disclaimer applies to contractual claims as well as, to the extent permitted by law, to non-contractual claims.
